These Terms of Service ("Terms") apply to your use of nicole-winters.com (the "Site") and to your purchase and use of The Garden of Eve, including the free edition (together, the "Book"). The Site and the Book are offered under the name Nicole Winters ("we", "us", "our"). By using the Site or buying the Book, you agree to these Terms. If you do not agree, please do not use the Site or buy the Book.

1. About the Book and Nicole Winters

The Garden of Eve is a work of fiction. Names, characters, places and events are products of imagination, and any resemblance to real persons or events is coincidental. "Nicole Winters" is an AI-generated author persona, and images of her on the Site are AI-generated. The Book is entertainment. Nothing in it is financial, legal, medical, relationship or professional advice.

2. Purchases and payment

• The full Book costs USD $10, plus any sales tax or VAT required where you live, which is shown at checkout.
• Payments are processed by Whop. Your payment is also subject to Whop's own terms and privacy policy. We never see or store your full card details.
• After payment you receive access to the Book in PDF and EPUB format through Whop.
• Prices may change at any time, but a change never affects a purchase you have already made.

3. Refunds

Refunds are covered by our Refund Policy, which forms part of these Terms.

4. Your license to read the Book

When you buy the Book (or download the free edition), we grant you a personal, non-exclusive, non-transferable license to download it and read it on your own devices for your personal, non-commercial use. You may not:

• copy, share, upload, sell, resell, lend or distribute the Book or its files, in whole or in part;
• post the Book or substantial parts of it online or in any shared library;
• remove copyright notices, or present the Book as your own work;
• use the Book or its text to train, fine-tune or build artificial intelligence or machine learning systems.

Short quotations for reviews or commentary, with credit, are welcome.

5. Intellectual property

The Book, its text, covers, the Site, its design and images are protected by copyright and other laws. All rights not expressly granted to you are reserved.

6. Acceptable use of the Site

Do not misuse the Site. For example, do not attempt to break its security, overload it, scrape it at scale, or use it for anything unlawful.

7. Disclaimers

The Site and the Book are provided "as is". To the fullest extent permitted by law, we make no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the Site will always be available or error-free.

8. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special or consequential damages arising from your use of the Site or the Book. Our total liability for any claim relating to the Site or the Book is limited to the amount you paid for the Book. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

9. Your consumer rights

Nothing in these Terms limits any rights you have under the mandatory consumer protection laws of the place where you live.

10. Changes to these Terms

We may update these Terms. The updated version will be posted on this page with a new effective date. The Terms in effect at the time of your purchase apply to that purchase.
